State requirement: No statewide requirement

Law: No state law  ·  Authority: WV DHHR  ·  Verified: September 2026

No state card, but most county health departments require one within 30 days of hire. Find your county below.

West Virginia is the state most often described wrongly. There is no statewide food handler card — but there is a state law that governs food handler cards, and most West Virginia counties do require one. Both halves of that sentence matter, and almost every other page gets one of them wrong.

Here is the actual structure: the state sets the rules for local cards, and each county health department decides whether to require one. Most do.

Quick answer

  • Statewide card? No. The state does not issue or require one.
  • Will you probably need one anyway? Yes — most county health departments require a card.
  • Deadline: 30 days from being hired.
  • Valid for: between 1 and 3 years, set by your county.
  • Cost: free to about $35, depending on county, duration and whether you go online.
  • Works in other counties? Only if you buy the statewide version — an extra $10, capped by statute.

The state law nobody quotes: W. Va. Code § 16-2-16

This is the provision that explains everything, and it is missing from almost every competing page. W. Va. Code § 16-2-16, headed “Food handler examinations and cards,” reads in full:

A food handler permit or card issued pursuant to the procedures put in place by a local county health department shall be valid for at least one year but not longer than three years. The permit or card shall be valid in all counties of this state, if the applicant pays an additional fee not to exceed $10. If required, a permit or card shall be obtained within thirty days of a person being hired in a restaurant or other applicable food establishment. The Bureau for Public Health shall develop minimum guidelines for training programs for individuals seeking a food handler permit or card that may be adopted by local county health departments. In lieu of state guidelines a local health department may use training courses developed by the American National Standards Institute or other nationally recognized entities for food safety training.

Read the two conditional words carefully. “If required” — the statute governs cards where a county requires one. It does not itself require anything of any West Virginia worker. And “may be adopted” — counties are not obliged to use the state’s training guidelines.

So the honest description of West Virginia is: no state mandate, but a state framework — a floor, a ceiling and a deadline — sitting over 49 local health departments that each decide for themselves.

What the statute fixes for every county

  • Validity must be between 1 and 3 years. A county cannot issue a six-month card or a lifetime one.
  • The reciprocity surcharge is capped at $10. See below — counties observe this precisely.
  • You get 30 days from hire. Where a county requires a card, this is the deadline.
  • ANSI-accredited training is expressly permitted as an alternative to state guidelines.

The $10 rule: county card versus statewide card

This is the most useful practical thing on this page. In most West Virginia counties you are offered two versions of the same card, and the difference is exactly $10 — the statutory cap, observed almost universally.

A county card is valid only in the county that issued it. A statewide card works in all 55 counties. If there is any chance you will change jobs across a county line — and in a state where the Charleston, Huntington and Morgantown labour markets pull across county boundaries, there usually is — the $10 is the best value in this entire subject.

County County card Statewide card Difference
Ohio County (Wheeling), 2 yr $10 $20 $10
Harrison (Clarksburg), 1 yr $15 $25 $10
Harrison, 2 yr $20 $30 $10
Harrison, 3 yr $25 $35 $10
Boone (online) $25 $35 $10
Taylor (Grafton) $25 $35 $10
Marion (Fairmont) $5 per year +$10 endorsement $10

Boone County states the point plainly: the statewide card “is acceptable in all of the 55 West Virginia counties.”

County by county: what the big ones charge

Fees and validity are set locally. These come from the health departments’ own pages. Always confirm with your county before paying — several run free in-person classes that their online partner pages do not mention.

Berkeley and Morgan counties (Martinsburg) are a live question. The Berkeley-Morgan County Board of Health approved a proposal in January 2026 to require food handler cards in both counties, with a stated effective date of 1 July 2026 and a comment period that ran to 24 May 2026. We have not been able to confirm from the department’s own pages whether it actually took effect, or what the fee and validity are. If you work in Martinsburg or Berkeley Springs, call the health department on 304-263-5131 rather than relying on any website, including this one.

Who counts as a food worker

Kanawha-Charleston puts it as broadly as any county in the country:

If you handle, prepare, serve, sell, or give away food for human consumption, even if you bus tables or wash dishes, you are a food worker and need this training within 30 days of starting work.

If you are wondering whether dishwashing counts, it does.

⚠️ The “West Virginia cards don’t expire” claim is a bill that died

You will find pages and forum posts saying West Virginia food handler cards no longer expire. They are describing House Bill 4620 from the 2024 session, which would have replaced the one-to-three-year rule with the words “does not expire.”

HB 4620 did not become law. It passed the House on 24 January 2024, went to the Senate Health and Human Resources Committee the next day, and died there. The 1–3 year rule in § 16-2-16 is still the law. Your card still expires.

There is no state list of approved courses

The Office of Environmental Health Services is unusually direct about this. Its own resources page carries the warning:

CAUTION: Please check with the local health department to see if they will accept an on-line food handler or food manager training course.

In other words, the state does not maintain an approved-provider list and does not vouch for any online course. Approval is a county decision. Jefferson County, for example, names a single provider and says it is the only approved route there.

Practically: do not buy a West Virginia food handler course until you have checked that your county accepts that specific provider. This is the single easiest way to waste money in this state.

What to do

Starting a food job in West Virginia: ask your employer which county health department covers the establishment, then check that department’s page or call it. You have 30 days. Ask specifically whether they accept the online provider you are considering, and whether they run a free or cheap in-person class — several do, and Cabell’s is free.

If you might change jobs, or work across a county line: pay the extra $10 for the statewide card. It is capped by statute and it is the best value here.

If you run an establishment: you have needed a certified food protection manager since 1 April 2024. The exemptions are narrow — prepackaged-only retail and temporary establishments.

Food handler card by West Virginia city

West Virginia issues food handler cards at the county health department level, so what you pay and where you go depends on your city. Here are the major ones:

Charleston (Kanawha County)

The Kanawha-Charleston Health Department issues food handler cards for Charleston, South Charleston, St. Albans, Dunbar, and the rest of Kanawha County. This is the state’s largest health jurisdiction by population. Expect the standard county card fee capped by state law.

Huntington (Cabell County)

The Cabell-Huntington Health Department issues cards for Huntington, Barboursville, and Milton. Cabell County has historically been the jurisdiction most likely to differ on process — check their current requirements before assuming a card from another county transfers.

Morgantown (Monongalia County)

The Monongalia County Health Department covers Morgantown, Westover, and Star City. Morgantown’s food service industry is heavily driven by West Virginia University, and the health department processes a high volume of student worker cards each semester.

Parkersburg (Wood County)

The Mid-Ohio Valley Health Department issues cards for Parkersburg, Vienna, and Williamstown. It also serves several surrounding counties.

Wheeling (Ohio County)

The Wheeling-Ohio County Health Department issues food handler cards for Wheeling and surrounding communities in the Northern Panhandle.

Martinsburg (Berkeley County)

The Berkeley County Health Department serves Martinsburg and the Eastern Panhandle. This region borders Maryland and Virginia — a West Virginia card does not transfer across state lines, so if you work in both states you will need separate credentials.

Beckley (Raleigh County), Clarksburg (Harrison County), Fairmont (Marion County)

Each of these cities is served by its own county health department, which issues food handler cards locally. Fees are capped by state law at $10, but processing and renewal steps vary by county.

Work across a state line?

Food handler rules follow the establishment’s location, not where you live. If you work in a neighbouring state, its requirements may be different:

Frequently asked questions

Does West Virginia require a food handler card?
Yes, in the counties that run a program. West Virginia law caps the fee, and the card is issued by your county health department rather than by the state. Cabell and Kanawha counties are the two most commonly searched.

How much does a West Virginia food handler card cost?
It depends on your county — state law sets a cap, but the actual fee, who issues it, and how you pay varies by county health department. See which applies to your county below.

Does every West Virginia county require a food handler card?
No. Requirements are set county by county. Check with the health department serving the county where the establishment sits, not where you live.

Can I use a card from one West Virginia county in another?
Not reliably. Cards are issued at county level and transferability is not guaranteed. If you work in more than one county, confirm with each health department.

How long is a West Virginia food handler card valid?
Validity is set by the issuing county health department. Confirm the expiry on your own card and renew through the same county that issued it.
